Cleopatra Group, engaged in the manufacture and export of ceramics, floor and wall tiles and sanitary sets, claim that Deco Tiles, formerly known as CTM Uganda, made orders to a tune of USD115,000 three years ago but have not been forthcoming with fulfillment of their financial obligation.

Egyptian ceramics firm, Ceramics Cleopatra Group, has engaged the services of Bowmans Uganda lawyers with express instructions to recover up to a half a billion shillings from Deco Tiles Uganda Ltd.

The Egyptian firm is suing Deco Tiles jointly with its managing director Gregory Magezi.

The two companies apparently entered an agreement for the supply of porcelain ceramics, floor and wall tiles as well as sanitary sets two years ago.

The Egyptian firm claims that, in September and October of 2014, the managing director of CTM Gregory Magezi placed two consecutive orders on behalf of CTM (U) Ltd.

The first order, invoiced on September 23, 2014, was in the sum of USD101,497 and the second order, invoiced on November 11, 2014, was for USD48,823.

The two consignments were duly delivered and accepted by CTM.

According to the affidavit, CTM made several promises to pay up but never did so, prompting the Egyptians to summon CTM managing director to Egypt to discuss arrangements of repayment.

To this effect, Magezi appeared in Egypt and, after a couple of meetings, signed a promissory note promising to pay USD 150,329.69 which money has to this date never been paid to Ceramics Cleopatra Group

Deco Tiles has yet tp file its defence to civil suit no. 186 of 2017 and for this, a default judgement was entered against them.

However, the managing director sought leave of court to defend the suit on his part and this was granted. In his written statement of defence, Magezi avers that the suit has been maliciously brought against him as the entire life of the contract he was acting on behalf of the company and not on his personal behalf and that the business relationship that existed between CTM and the complainant.

He argues that Ceramics Cleopatra Group was well aware of during the dealing and at the time of filing the suit.

Magezi denies any liability on his part and begs court to dismiss the suit with costs.

The parties were today (March 14) order by Justice Elizabeth Jane Alividza to return to court on July 4 for hearing of the case.
